One of the root problems in society today is, in order to live on land you must pay a monthly payment or rent that is often out of reach of most average people.
So one of the ways we can help society is to reduce those costs and, in additon, to keep the rents circulating within the community before they get siphoned off to banks in the form of mortage. One idea, is to utilize the legal structure known as a "Trust". This is a form of legal ownership that is passed down from common law. This form of ownership divides the title into 2 parts the first part is called "the beneficiary" this is the the monetary value of the actual land, and the second part of the title is the "trustee" this part of the title is the actual legal ownership over the land and all things attached to it.
We believe this simple restructuring of agreements could be the start to a new way to think about the ownership and stewardship of land.
We do not want a limit scenarios or possible concepts, we hope that this is the spark of many unique agreements between current landowners and future stewards. We believe that if a productive person could be allowed to access farmland or productive any other piece of property at a low cost with no bank requirements or hoops to jump through and instead of paying a mortgage to a bank each month. The could be allowed a lower cost acces to a piece of propety , though any number of long term or short term leases that could all parties involved. Our society could be allowed the framework to begin a process of reinvention of land ownership.
The trustee of the long term transferable lease would give a small donation back to the land trust(nonprofit) every month or yearly they would also pay their property taxes and insurance but they would not be required to purchase the actual land. Any variety of options could arise, it is not clear the route that any property would need to be eventually donated to the trust but many exist. The benefit to the trustee is a low cost access to land where his rents go to furthering the benefits to his community. That trustee could then avoid paying, let's say a $1000 a month and only pay $300 a month for access to a piece of land that would allow them to be productive. They could then presume pursue, any form of productivity that would benefit themselves and their community. A person would not have to work for 30 years at a job they may or may not enjoy in order to only own the rights to occupy a piece of land for the rest of their existence if they so choose.
A person would then be able to pursue their passion in a way that would benefit their community and the land trust in the form of monthly donations in lieu of rents. The steward or trusty would have a long term lease to the access of that land that would be completely transferable or saleable, we believe any length up to 33 years would make the most sense. 33 years is the typical length of one generation, so each person would in their life time be a part of the renegotiation of their lease or renewal/transfer. This trustee would be allowed or have the ability to transfer that lease to his kids or anyone he deemed worthy of the responsibility to continue the stewardship of that land, this can be a 100% donation are 100% sale, our goal is to allow full expression of the possibilities. The benefit of using a trust structure, for ownership of land, this that it would allow the ease of transfer between any individuals or companies or non profits; which in most cases is to simply be able to file a piece of paper in the land trust filing cabinet. Capital gains need not apply in this form of transfer.
Over time as more properties are acquired and purchased from banks, and deeds held in trust, this would allow more and more revenue to a nonprofit or nonprofit cell to been be able to purchase more land and subsequently, to then lease to at low cost. Which means the nonprofit could survive in perpetuity due to the new wayin which it structures or organizes ourselves regarding land ownership and stewardship. Our orgnaization is what makes us one organism, we can choose a parasitic or a symbiote.
The nonprofit will also provide the online space or forum where we can share legal contracts ideas and project overviews. We do not claim to have the answers of how to best structuce these concepts, but we are very confident that using in adaptive model and allowing for complete expression of all the possible ideas and how these agreements can be made, we will eventually find concepts and structures that work. Therefore, if we can house the agreements and best practices in one place as if a formal body of knowledge ,we should be able to learn to and therefore adapt to a new way of organization. The beauty of this idea is that it does not require a single piece of legislation or law or to fight any battles. This concept only requires us to think differently and be more creative.
It only requires the initial golden seed, the initial piece of property and like minded individuals to plant a seed of ideas where any possibilities could take shape. It is not a requirement of lawlessness or anarchy or any form of divisive ideas. In a basic sense it is exactly what most of us already envisioned would happen with the the improvements we do to property. As long as we personally can benefit and our families can benefit from our labors that we expended while utilizing a piece of land. With this shift in concept any possibility for transfer of that land exists.
The golden Seed Land Trust's goal is to provide the legal structure, concepts and platform for society in order for us to implement new ideas with regards to the transfer and stewardship of land.
